Initial Contract Term: 8-10 months

- Web Monitoring
Conduct monitoring activities of websites for inappropriate use of the two specific Trademarks to be provided to successful candidate name and marks.
Web monitoring activities include results from domain scans, keyword scans, and image scans. Monitoring must occur across a variety of retailers, including big box stores and e-commerce sites in the Canadian marketplace.
Results must be reported on a regular basis. Web monitoring must include the following activities:
- Unauthorized non-Participant use:
Reports must identify unauthorized use of the provided trademark brand including the name and marks Images and name to be provided
Any non-authorized organization non-Participant using those trademark brands must be included in the monthly reports;
- Unauthorized uncertified product use:
The web monitoring service must be able to identify uncertified products that are using the certification mark of trademark brand
Product models found using the trademark certification mark online must have their product model numbers compared to the trademark’s Searchable product list.
Any product model not found on the list must be reported as non-compliant/Misuse;
- Whitelisting capabilities:
The service must be able to whitelist authorized Trademark’s Participants from web monitoring activities to reduce the frequency of false positives.
2. Enforcement services
Tracking all activities of misuse, keep records, assigning internal document references# as per ISO standards, and documents management
We will review cases of misuse as identified in monthly reports of all activities identified in the above step and submit actionable cases for enforcement.
Cases must be enforced through cease-and-desist letters prepared by keeping a record of every documentation against each case/product/misuse.
Candidate must track all actionable cases and manage records per ISO standards. Any response to cease and desist letters must be provided directly to us
3.Misuse Cases Reporting
- Prepare Analytical Report of misuse cases as identified in all above activities
- Include Tracking Mechanism of misuse cases
- Trackable Action Items and misuse cases where the owners are contacted
4. Deliverables and Payment Milestones:
Provide monthly brand infringement and enforcement report to Project Authority timeline to be defined
Candidate’s Obligations:
- return all materials belonging to us, upon completion of the contract.
- submit any written reports in electronic format
- Brand Monitoring reports: Microsoft Excel.
- Analytic Reports: in graphic form in Microsoft Excel and Word.
- participate in teleconferences with client if needed.
- The code, documents are company’s property and candidate will have no rights to use this code anywhere esle.

Candidate must provide a detailed work plan covering all the stated requirements for web monitoring.
The plan should set out each of the following elements:
a The specific activities;
b Timelines;
c The level of effort and resource for each activity;
d understanding of web monitoring activities and requirements;
e Methodology and execution with identifying potential problems and proposed solutions;
f Approach and understanding of the expected deliverables such as quality control and reporting systems, and the processes in place to ensure successful delivery of the work.
Methodology and Approach Enforcement Services
Candidate must provide a detailed work plan covering all the stated requirements for enforcement services.
